DSS Picks Up El-Rufai After Court Grants Him Bail

Former Kaduna State Governor, Mallam Nasir el-Rufai, was returned to the custody of the Independent Corrupt Practices and Other Related Offences Commission (ICPC) late Monday afternoon, following a tense standoff between security agencies and a public protest by his family over his legal placement.

The transfer, confirmed by security sources around 5:00 PM on Monday after a meeting between all legal counsels involved in the case, followed allegations from el-Rufai’s family that the Department of State Services (DSS) had breached subsisting court orders by briefly taking him into their custody.


Alleged Breach of Remand Orders

The dispute arose following a morning session at the Federal High Court in Abuja, presided over by Justice Joyce AbdulMalik. According to el-Rufai’s second wife, Hasiat, the court granted bail but stood the matter down until 1:00 PM. During the recess, DSS officials reportedly attempted to detain the former governor at their facility.

Hasiat stated that el-Rufai resisted the transfer, citing two separate orders from a Kaduna court directing that he remain remanded specifically with the ICPC. While he was temporarily returned to the ICPC for the afternoon session, the family alleged that another attempt was made to move him to the DSS facility after the court adjourned the case to the following day.

Addressing journalists outside the DSS facility, Hasiat recounted that her husband refused to leave the transport vehicle, demanding compliance with the established legal agreements.

"When Justice AbdulMalik said I should go to DSS in the first instance, we told her that there are subsisting orders," Hasiat said. "And she said, let DSS and ICPC go and decide who will keep him—and you people decided they are keeping him with ICPC. What has changed?"

Medical Access Concerns

The family further alleged that el-Rufai, who has been detained for 91 days, is being denied adequate medical attention in violation of an order issued by Justice Aikawa of the Kaduna State High Court. The order granted the former governor unfettered access to his legal team and personal physicians.

According to Hasiat, an internal ICPC medical officer had recommended diagnostic testing. However, subsequent appointments for independent doctors to review the results with el-Rufai were reportedly blocked by authorities, who claimed the former governor had not been formally notified of the visit.


Allegations of Political Motivation

The legal proceedings and the stringency of the bail conditions have drawn sharp criticism from el-Rufai’s representatives and political allies, who argue the case is politically driven.

  • Bail Conditions Contested: Hon. Bello el-Rufai, a member of the House of Representatives and the former governor's son, questioned the feasibility of the bail terms. He noted requirements demanding attestations from the Kaduna State Council of Chiefs and sureties who are Grade Level 17 civil servants owning property in upscale Abuja neighborhoods like Asokoro or Maitama. "Which civil servant has $\text{N}100 \text{ million}$ legally?" he questioned, adding that he intends to file a formal petition regarding the matter before the House of Representatives.

  • Claims of Psychological Harassment: Dr. Uche Dialla, Director General of the el-Rufai Support Group Association, argued that shifting a detainee between different agency facilities without administrative cause violates international conventions against psychological torture.

  • Voluntary Submission: Senator Lawal Adamu (Kaduna Central) called for el-Rufai's immediate release on self-recognizance, highlighting that the former governor had voluntarily flown back from Cairo to cooperate with the ICPC investigation when summoned.

The family has formally demanded strict adherence to existing court orders regarding custody placement, full restoration of medical access, and an end to the administrative disruptions surrounding his detention. Proceedings are scheduled to resume tomorrow at the Federal High Court.
