The Court of Appeal has delivered a judgment setting aside a previous Federal High Court decision that sought to de-register the African Democratic Congress (ADC) alongside four other political parties. The ruling has been met with approval from political stakeholders, who view it as a significant development for multi-party democracy in Nigeria.

In an official statement, the Atiku Media Office stated that the appellate court’s ruling removes existing legal barriers that could have impacted the ADC's participation in the upcoming 2027 general elections. The decision, combined with a separate Federal High Court judgment affirming the leadership of the Senator David Mark-led National Executive Committee, resolves pending disputes regarding the party's status and internal administration.

Key Legal Grounds of the Ruling

The appellate court based its decision on several legal principles:

  • Nullification: The court held that the lower court's judgment was void because it was delivered in disregard of an active order from the appellate court.

  • Locus Standi: The respondents were found to lack the legal standing to bring the suit forward, and their claims were deemed speculative.

  • Constitutional Interpretation: The court clarified that Section 225A of the Constitution must be interpreted disjunctively rather than conjunctively.

  • Procedural Timing: The suit was ruled premature, as the election cycles in Osun and Ekiti states were ongoing at the time of filing.

  • Evidence Handling: The trial court was faulted for disregarding affidavit evidence from the Independent National Electoral Commission (INEC), which verified that the affected parties had met statutory and constitutional requirements.

Implications for the 2027 General Elections

The ruling is regarded as a safeguard for political pluralism, emphasizing that political competition should be determined by the electorate rather than through litigation. Representatives from the political opposition warned against utilizing state institutions to diminish the democratic space, asserting that the judiciary serves as a vital guardian of constitutional democracy.

With the legal status of the ADC validated and leadership disputes resolved, the party is positioned to participate in the upcoming electoral cycle amidst broader political realignments.
